1. What exactly is an uncontested divorce?
An uncontested divorce is when both spouses agree on all the major issues, like division of property, debt, and (if applicable) custody. There's no court battle, and it's often faster, much cheaper, and less stressful.
2. Do we have to be on speaking terms to do this?
No, I will do that for you. I will represent you. As long as both parties agree and are willing to sign the paperwork, communication is not necessary. Many long-separated couples complete the process without ever speaking directly.
3. How long does an uncontested divorce take?
In Arkansas, you have to wait at least 30 days after filing for divorce before it can be granted. After that, how long it takes depends on your county and how fast you turn in all the papers. Divorces where both people agree usually finish faster than ones where they don’t.
4. Can we file if we’ve been separated for years?
Yes. This situation is more common than you think. Even if you’ve been living apart for a long time, an uncontested divorce can formally and peacefully finalize the separation.
5. Can you Guarantee I will get a Divorce?
No lawyer can guarantee that you will get a divorce, but in most uncontested divorce cases, the outcome is very predictable.
Even if the other party doesn’t respond to the divorce filing, that can actually make the process easier and we can still move forward to get your divorce finalized.
